...for the petitioner This application under Article of the Constitution of India is at the instance of the petitioner in Miscellaneous Case No. 34 of 2022 arising out of Title Execution No. 49 of 2018 praying for a direction upon the learned 1st Civil Judge (Junior Division), Sealdah to dispose of the miscellaneous case expeditiously. Mr. Anshunath Chakraborty, learned advocate appearing for the petitioner submits that the evidence of the petitioner has already been concluded and the date has been fixed for evidence of the opposite party witness. He further submits that the evidence of the opposite party witness has been fixed on August 30, 2025.

In view of the order sought and proposed to be passed there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite parties or the learned advocates representing the opposite party before the learned Executing Court.

It appears from the order sheet that the regular Presiding Officer is not available and the miscellaneous case is being dealt with by the learned Judge-in-Charge. In view thereof, C.O. No. 3057 of 2025 stands disposed of by observing that after the regular Presiding Officer joins, steps shall be taken to dispose of the Miscellaneous Case No. 34 of 2022 as expeditiously as possible without granting any unnecessary adjournments to either of the parties.

With the aforesaid directions, CO No. 3057 of 2025 is disposed of.

There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
