24.01.2024 Srimanta Sl. No. 31 Ct. No. 655 CO/2782/2015 Golam Rahaman Khandekar -Vs.- Hamida Begam & Ors.

There is no representation on behalf of the petitioner.

It appears that the instant revisional application filed under Article 227 of the Constitution of India filed by the petitioner was earlier dismissed for default by passing the order dated 04.12.2015. Thereafter, an application was taken out by the petitioner praying for restoration of the said revisional application to its original file and number and the said application was allowed and the revisional application filed by the petitioner was restored to its original file and number. It appears that the petitioner has lost interest to proceed with the present application and accordingly there will be no justification to keep this revisional application alive in the list. At the time of disposal of this revisional application it is noticed that the impugned order under challenge has not been annexed with the application. Despite that the Department entertained the present application. Department is hereby directed to be more cautious in future in accepting the application without certified copy of the impugned order.

Accordingly, the revisional application being no. CO/2782/2015 is hereby dismissed for default. Interim order, if any, stands vacated.

There will be no order as to costs.
