The petitioner is serving as a Collecting Sarkar since 2017. He seeks benefit in terms of the memo no. 137/PAN dated 7th February, 2022 issued by the Additional District Magistrate (Panchayat), Purba Bardhaman.

By the said memo, the Additional District Magistrate intimated the Block Development Officers of all the development blocks that 33% of the total number of posts of Gram Panchayat Karmee should be filled up from the existing eligible Collecting Sarkar who rendered satisfactory service for at least six years in any Gram Panchayat under the jurisdiction of the concerned Panchayat Samiti.

The memo mentions that the details are to be submitted in the format by 15th February, 2022. The petitioner has forwarded a representation on 17th July,

2023 to the BDO seeking benefit of the aforesaid memo.

The said representation is pending consideration.

Without entering into the merit of the claim of the petitioner as to whether he will get the benefit of the aforesaid memo as it appears that the representation of the petitioner is pending consideration at the end of the BDO, accordingly, the instant writ petition is disposed of by directing the respondent No. 4 to take a decision on the application filed by the petitioner in accordance with the memo referred to hereinabove at the earliest but positively within a period of four months from the date of communication of this order.

If the petitioner is found eligible, then necessary consequential steps shall be taken.

The writ petition is disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
