Case No. 837 of 2009, presently pending before learned Additional Chief Judicial Magistrate, Barrackpore. It is submitted on behalf of the petitioner that the proceeding was instituted in year 2009 but till date only one witness have been examined in part out of 10 charge-sheeted witnesses and accordingly he prays for a direction upon the Court below for expeditious disposal of the aforesaid proceeding.

It is submitted that a copy of the application is given to learned Counsel for the opposite party.

Having heard learned Counsel for the petitioner and the opposite party no.2, it is unfortunate that the case is pending for more than 16 years, still it could not reach a logical conclusion. In such circumstances, I find that the prayer made by the petitioner is justified and required to be allowed for the ends of justice. I am also informed that the next date for recording evidence is fixed on 8th January, 2026.

In such circumstances, CRR 3681 of 2025 is hereby disposed of with a direction upon the Court below to make every endeavour for expeditious disposal of the aforesaid G.R. Case No.837 of 2009 and, if required, he will conduct day to day trial without granting any unnecessary adjournment to either of the parties and to make his best endeavour to conclude the entire proceeding preferably within a period of six months from the next date of evidence. This order is passed invoking this courts jurisdiction under section 529 BNSS.
