Heard learned counsels for the parties.

The title and possession of the petitioner in respect of the property in question has been declared by the learned Civil Court by an order passed on 22nd March, 2024. Learned counsel for the petitioner submits that despite such order the private respondents are disturbing his peaceful possession in respect of the property for which an application has been filed by him before the police authority.

Admittedly, an FIR has been registered pursuant to the said complaint and investigation is in progress. In view of the order passed by the learned Trial Court, the police authority is directed to ensure that the said order is complied with and there is no breach of peace and tranquility in the locality insofar as the said order is concerned.

The writ petition is disposed of accordingly.

There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
