Criminal Revisional Jurisdiction 30-01-2024 Subha Item no. 81 Ct no.34 CRR 3019 of 2023 Swapan Baidya and anr.

-versus- Md. Abdul Mannan Malllick Earlier the revisional application was called on 22nd August, 2023 when an accommodation was sought for on behalf of the petitioners. Today, when the revisional application has been called, none represented the petitioners.

The subject matter of challenge relates to the order dated 0805-2023 wherein the learned Sessions Judge, FTC no. 3, Barasat in Criminal Revision no. 249 of 2019 was pleased to dismissed criminal revision no. 249 of 2029 for default. Petitioners being aggrieved have approached this court. Petitioners would be liberty to take out an appropriate application for recording of the said order assigning the appropriate reason before the learned Additional Sessions Judge, FTC-3, Barasat in connection with Criminal Revision No. 249 of 2019. If the cause shown is bona fide, the learned sessions court will consider the same in accordance with law without being influenced by any observations made by this court.

With the aforesaid observations, the revisional application being CRR 3019 of 2023 is disposed of.

Pending applications, if any, are disposed of accordingly. All concerned parties are to act in terms of a copy of this
