Mr. Somnath Saha ...for the petitioner The petitioner challenges a certificate of mutation (appearing at page 32 of the writ petition) issued in favour of one Mistee Kazi (Ahmed), respondent no.5, in respect of plot no. 658P(RS) Khatian No.779, J. L. No.17, Mouza - Krisanapur, 24 Parganas (North).

The petitioner alleges that respondent no.5 is a citizen of Bangladesh. Therefore, no such mutation could have been carried out in her favour.

Learned advocate appearing for the petitioner submits that the petitioner has made a representation before the Joint Municipal Commissioner, Bidhannagar Municipal Corporation dated July 22, 2024, for cancellation of the mutation, but the same has not yet been considered.

In the light of the aforesaid, this writ petition is disposed of with a direction upon the Joint Municipal Commissioner, Bidhannagar Municipal Corporation, respondent no.2 to consider the representation appearing at page 46 of the writ petition and to pass a

reasoned order within a period of three months from the date of communication of this order in accordance with law after giving an opportunity of hearing to all concerned.

Accordingly, WPA 20131 of 2024 is disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties on compliance of usual legal formalities.
