The present application under Section 439 of the code of Criminal Procedure has been preferred by the petitioner in connection with Belghoria P.S. Case No. 369 of 2015 under Section 420 of the Indian Penal Code.

Records reflect that on 12.08.2015, the matter was released by a Division Bench of this Court. Thereafter the matter again appeared on 20.11.2019 and none represented the petitioner. The bail application is pending for about six years and none has pursued the matter before this Court for such long period. The present bail application was preferred challenging the order dated 01.07.2015. As such, I am of the view that the present bail application by efflux of time has become infructuous.

Accordingly, the application for bail, being CRM 7019 of 2015, is dismissed as infructuous.
