The 1st petitioner is the married daughter of Parimal Mandal who was an employee of Ramchandrapur Gram Panchayat and died in harness on 21st November, 2006. The 2nd petitioner is his widow. The 2nd petitioner applied for compassionate appointment before the concerned authority repeatedly but received no response. She finally withdrew her claim and submitted an application stating that she had no objection if her daughter (the 1st petitioner) was granted the compassionate appointment. The 1st petitioner also made several applications for compassionate appointment before the authority which were not considered. The applications were forwarded by the District Panchayat Rural Development Officer, Bankura to the Block Development Officer, Mejia Block, Bankura for causing an enquiry and furnishing a status report with all relevant documents pursuant to the notification no. 251Emp dated 3rd December, 2013 issued by the Labour
Department, Government of West Bengal and all subsequent notifications in this regard. The 1st petitioner seeks consideration of her prayers for compassionate appointment.
Learned counsel for the State submits that the prayer of the 2nd petitioner was turned down in terms of the notification of the Labour Department dated June 6, 2005 on the ground that she was not eligible for the appointment. The 1st petitioner has filed the application much beyond the statutory period of time.
In reply, learned counsel for the petitioners submits that the 1st petitioner made several applications within the statutory period of time before the authority which were not considered.
Upon consideration of the submission made on behalf of the parties, this Court is inclined to hold that since the applications made by the 1st petitioner have been forwarded to the Block Development Officer for causing an enquiry and furnishing the status report along with all relevant documents pursuant to the Labour Department's notification dated 3rd December, 2013 and all subsequent notifications issued from time to time in this regard, the Block Development Officer, being the 6th respondent herein, is directed to take necessary steps in terms of the letters issued by the District Panchayat and Rural Development Officer, Bankura, being the 5th respondent herein, within three weeks from the date of communication
of this order. Upon receipt of such information from the 6th respondent herein, the 5th respondent shall deal with the issue and dispose of the applications filed by the 1st petitioner within two weeks thereafter.
The writ petition is accordingly disposed of. There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
