..for the petitioners Mr. Amal Kumar Sen Mr. Lal Mohan Basu ..for the State It is the case of the petitioners that they are employed as Tax Collectors under the Gram Panchayat authorities within the district of Howrah. The petitioners submit that the District Panchayat and Rural Development Officer, by a letter dated February 19, 2022, forwarded their names for verification and modification to the concerned Block Development Officers of the district.

They further state that the verified and/or modified lists prepared by the respective Block Development Officers were forwarded to the District Panchayat and Rural Development Officer, Howrah

by March 2, 2022. However, no effective steps were thereafter taken by the said authority.

Mr. Sen, learned advocate appearing for the State, has referred to page 126 of the writ petition to contend that the District Panchayat and Rural Development Officer, Howrah, by a letter dated March 24, 2023, addressed the following communication to the State PRI Cell:

"After reconstitution of the DLSC the process of compilation of the details of Tax-Collectors has been undertaken.

These data needs to be rechecked and re-matched. Once the verification and data rechecking are done the meeting of DLSC will be convened once the approval is obtained. The entire process needs to be undertaken afresh. The process is under way and in course of time the promotion process will be given effect following the extant rules and norms."

The petitioners submit that they have made a representation dated July 18, 2024, before the District Panchayat and Rural Development Officer, Howrah, requesting expeditious consideration of their claim, which appears at page 134 of the writ petition.

It is contended that the petitioners may become age-barred for consideration of promotion if the process is not expedited.

In the circumstances, there is no justification for keeping the writ petition pending.

Accordingly, in the facts of this case, the District Panchayat and Rural Development Officer, Howrah, is directed to consider the representation appearing at page 134 of the writ petition, strictly in accordance with law, as expeditiously as possible, preferably within a period of six months from the date of communication of this order.

Accordingly, WPA 20082 of 2024 is disposed of.

Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
