Affidavit of service filed on behalf of the petitioners be kept with the record.

The petitioners intend to participate in response to the notice inviting e-tender floated by the office of the District Magistrate, Birbhum, ICDS Cell. The bid submission date has already started, but the last date of the bid is August 29, 2025.

The petitioners participated in the pre-bid meeting and have submitted a representation before the authority requesting revisiting and reconsideration of certain terms and conditions set out in the notice inviting e-tender. The said representation is yet to be considered.

It has been submitted that if the authority does not take a decision prior to the closing date of the bid, then the petitioners would be highly prejudiced as they will not be in a position to submit bids in respect of the storing and carrying project simultaneously.

I have heard the submissions made on behalf of the petitioners and the State respondents.

As the bid process is still on, the Court would not like to comment anything with regard to the notice inviting e-tender. A request from the petitioners is pending consideration before the District Programme Officer, ICDS Cell Birbhum.

In view of the above, the instant writ petition is disposed of by directing the Additional District Magistrate (Development), Birbhum and Nodal Officer, ICDS being the respondent no.3 herein to take a decision on the petitioners'

representation in accordance with the prevailing guidelines.

The authority may consider affording an opportunity of hearing to one of the representatives of the petitioners and any other necessary party to actually ascertain the problem that the petitioners are facing.

A decision shall be taken by the authority latest by August 28, 2025. A reasoned order shall be passed and communicated to the petitioner on or before August 28, 2025.

Learned advocate for the petitioners is directed to forward a copy of the representation along with other supporting documents to the aforesaid respondent at time of communicating the order of this Court.

Any communication by the respondent authority may be addressed to the learned advocate for the petitioners in the e-mail address as provided in the covering letter that will be forwarded by the learned advocate to the respondent authority.

The writ petition is disposed of.

Parties to act on the basis of the server copy of this order duly downloaded from the official website of this Court.

Urgent Photostat certified copy of this order, if applied for, be supplied to the parties, subject to compliance of all requisite formalities.
