The impasse in the present case may be resolved by directing the First Appellate Authority under the Right to Information Act, 2005 being the West Bengal Board of Primary Education to dispose of the application made by the petitioner under Section 19(1) of the 2005 Act within a period of 30 days from today.

Even though the First Appellate Authority is not a party to the writ petition, this order is passed one of necessity since the second appellate authority demitted office on and from 1st June, 2022 and there is, hence, no authority as of present to dispose of the second appeal filed by the petitioner. This court has been informed that advertisements for the post of Second Appellate Authority have been made by the State in October, 2022.

W.P.A.19856 of 2022 is disposed of in terms of the above direction.
