Mr. Soumen Kr. Dutta ..........for the petitioner None appears for the respondents at the time of call. No accommodation has been sought for either. Mr. Dutta, learned advocate appearing for the petitioner submits that the petitioner, till the death of his father, was working as a Nayeb Kazi within the jurisdiction of Kultali Police Station and his father at the relevant point of time was functioning as the Muslim Marriage Registrar under the said police station.

After the death of the father of the petitioner, a representation was submitted by the petitioner through his learned advocate requesting the Inspector General of Registration to appoint him as the Muslim Marriage Registrar for Kultali Police Station. Mr. Dutta further submits that no decision on such representation has yet been communicated by the respondent to the petitioner or his learned advocate. Since the representation submitted by the petitioner is dated 26th December, 2001, this Court

directs the petitioner to submit a fresh representation annexing a copy of the aforesaid representation dated 26th December, 2001 within a period of two weeks from the date of receipt of server copy of this order. Without entering into the merits of the claim of the petitioner, this Court is of the considered view that the interest of justice would be subserved if a direction is passed upon the Inspector General of Registration being the respondent no. 1 to this writ petition to decide the claim of the petitioner. Accordingly, the respondent no. 1 is directed to consider the representation of the petitioner to be submitted in terms of this order and after giving an opportunity of hearing to the petitioner, any other interested parties, whose rights may be affected and/or their authorised representatives to dispose of the same by passing a reasoned order and communicate such order as expeditiously as possible but positively within a period of four weeks from the date of submission of a representation in terms of this order.

With the aforesaid directions, the writ petition stands disposed of.

There shall be, however, no order as to costs. Urgent photostat certified copy of this order, if applied for, be furnished to the parties expeditiously upon compliance of all legal formalities.
