Z. N. Khan Mujibar Ali Naskar ... For the State The petitioner is in custody for about 60 days and prays for bail.

Learned counsel for the petitioner submits that pursuant to property dispute between the family members, a hot altercation took place followed by the alleged assault.

Learned counsel for the State opposes the prayer. I have considered the material on record.

The petitioner appears to have assaulted the victim leading to grievous injuries. The victim was treated at the hospital. Investigation is in progress. The petitioner undertakes to cooperate in investigation. The material available does not justify further detention of the petitioner.

Accordingly, the prayer for bail is allowed.

The petitioner namely Reshma Bibi shall be released on bail upon furnishing bond of Rs.10,000/- (Rupees Ten Thousand only) each, with two sureties of like amount each, one of whom must be

local, to the satisfaction of the learned Additional Chief Judicial Magistrate, Barrackpore subject to condition that she shall cooperate in investigation of the case and shall respond to the investigating officer as and when required.

The application for bail is disposed of.
