For the Petitioner Learned Advocate for the petitioner is aggrieved by the fact that the complaint case was initiated in the year 2017 and till date the examination under Section 251 of the Cr.P.C. has not been completed.

According to the Learned Advocate, the accused persons are willfully evading the process of law so that the trial of the case cannot proceed.

Having regard to the grievance so expressed by the petitioner and the fact that the next date has been fixed on 5th of February, 2024, I direct that the Learned Judicial Magistrate, 1st Court, Barrackpore, would complete the process of examination of the accused under Section 251 of the Cr.P.C. on the next date so fixed or, within a fortnight thereafter.

On and from the month of March, 2024, the Learned Trial Court would fix at least one date in a month so that the

trial of the case should reach to its logical conclusion within a reasonable period of time. No unnecessary adjournment shall be granted to either of the parties and the Learned Trial Court would take endeavour so that the examination of the prosecution witness is completed within a period of three months from the month of March, 2024. All efforts be taken so that the trial of the case is completed in course of the year and judgment be pronounced by the Learned Trial Court on 31st of January, 2025.

With the aforesaid observations, CRR 3025 of 2023 is disposed of.

Pending application, if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court at Calcutta.
