Petitioner has approached this Court as he claims that his brother has been illegally taken to Kharagpur Rescue Foundation from where he has been missing.

Petitioner further claims that the wife of the said Subrata Roy who has been detained has an oblique motive which arises out of matrimonial discord and is using the police authorities for detaining the petitioner's brother in Kharagpur Rescue Foundation, although the petitioner's brother is not suffering from any post-drug addiction or any psychological or medical issues.

Learned advocate appearing for the State has submitted a report. Report has been prepared by the Inspector-in-Charge, Kharagpur Town Police Station which reflects that an admission form has been filled up which was on 9th of August, 2025 signed both by the patient namely, Subrata Roy and one Sangita Roy. A document has been enclosed which reflects that due to alcoholism and psychological problem, the said Subrata Roy is under treatment at Kharagpur Rescue Foundation. Having considered that the wife has taken steps for treatment and the brother of the petitioner has approached this Court, prima facie, I am of the view that there is a family feud in which the police authorities have been forcefully incorporated which is baseless.

Petitioner if he is aggrieved and has materials in his possession would approach the jurisdictional Magistrate for necessary reliefs. With the aforesaid observations WPA 19340 of 2025 is disposed of.

Report so submitted be kept with the record. Copy of the report be handed over to both the parties.
