The present revisional application has been filed by the petitioners / complainant in Complaint case no.66588 of 2022 pending before the learned Judicial Magistrate, 5th Court, Calcutta. By filing the petitioner has prayed for a direction upon the learned Trial Court for early disposal of the petition under Section 143(A) of the Negotiable Instruments Act, 1881 on his behalf.

It transpires from the materials before this Court that the case being CS 66588 of 2022 was fixed for recording evidence on behalf of the complainant. In the meantime, the complainant came up with an application under Section 143(A) of the N. I. Act on February 15, 2024. The case is fixed for hearing of such application on December 18, 2025. It is submitted by the learned advocate for the petitioner that a direction be issued so that the said application be heard and decided on the day fixed.

In the facts and circumstances of the case and upon going through the materials on record, it would be appropriate to dispose of the instant revisional application by requesting the learned Trial Court to dispose of the application under Section 143(A) of the N. I. Act filed on behalf of the petitioner as early as possible without affording any unnecessary adjournment to either of the parties. 4.

Accordingly, CRR 3693 of 2025 is disposed of. 5.

All parties shall act on the basis of server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties after completion of all necessary formalities.
