Learned advocate appearing for the petitioner has drawn the attention of the Court to the bank statement which reflects that a sum of Rs.24,415/- is being paid from Ranaghat Treasury. Learned advocate submits that there is no scope of the observations made by the learned Magistrate that the pension is between Rs.26,000/- to Rs.28,000/- per month.

In view of the submissions advanced, if there is no alteration in the amount in respect of the pension which is being received by the petitioner which is Rs.24,415/-, the quantum so enhanced by the learned Magistrate from a sum of Rs.5000/- to Rs.9000/-, in the circumstances is fixed at Rs.8000/- which is 1/3rd of the pension amount received by the husband. The mode and manner in which the same is to be paid and the date from which is to be paid will be in accordance with the order passed by the learned Additional Chief Judicial Magistrate, Ranaghat, Nadia.

With the aforesaid observations, the revisional application being CRR 3253 of 2022 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
