Mr. Saibal Kumar Acharyya Mr. Tarun Kumar Das Mr. Pradip Paul Ms. Renesa Dey ..for the Appellant Ms. Parna Roychowdhury ..for the respondent Bank Appeal is directed against the order dated December 14, 2021 passed in W.P.A. 19427 of 2021. By the impugned order, learned Single Judge did not grant relief of age relaxation to the appellant to participate in any selection process to be conducted by the respondent bank.

Appellant and the respondent bank are represented. Apparently, there was an advertisement issued by the respondent bank for the purpose of appointment to the Group-D post. Last date for applying such post in terms

of such advertisement expired on December 15, 2021. Such selection process was not continued with. When a person is working as temporary worker under the organization over a period of time, this High Court from time to time allowed such person to participate in the regular selection process by condoning the age bar. Similar facility should be extended to the appellant. In such circumstances, in the event, the bank undertakes any fresh recruitment process for Group-D staff or continues with the suspended selection process as impugned in the writ petition, then the bank will permit the appellant before us one opportunity to participate in such selection process by condoning the age bar. It is clarified that no other essential condition excepting the age bar will be condoned so far as the appellant is concerned in such selection process.

With the aforesaid observations, M.A.T. 1349 of 2021 along with CAN 1 of 2021 are disposed of without any order as to costs.
