Counsel for the appellant submits that the appeal is being filed against a non-appealable order dated April 21, 2023. He seeks leave to withdraw the same with liberty to challenge the said order dated April 21, 2023 by the appellate authority, Metro Railway, Calcutta, before the appropriate forum.

Reserving leave as prayed for by the counsel for the appellant, F.M.A.T. 362 of 2023 shall stand dismissed as withdrawn.

Leave is granted to the appellant to take back the certified copy of the impugned order after replacing the same with the xerox copy.

Interim orders, if any, shall also stand vacated. 5.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
