The application being CAN 1 of 2024 is for recall of the order dated 5th February, 2024 passed by this Court on the connected writ petition. The application is heard in presence of the learned advocates representing the petitioner, CESC and the respondent no. 5.

The learned advocate representing respondent no. 5 has opposed the prayer for recalling of the order dated 5th February, 2024 and in support of the same, attention of this Court has been drawn to the averments made in the application in paragraphs 4, 5, 6 and 7.

On perusal of the application this Court finds that an explanation has been offered on the day at the time when the writ petition was dismissed the learned advocate for the applicant could not reach the Court which appears to be satisfactory explanation. Accordingly, the order dated 5th February, 2024 stands recalled.

The writ petition is restored to its original file and number.

The application being CAN 1 of 2024 is allowed and disposed of.
