Applicant Mr. Kalyan Krishna Nandi ...for the Applicant-in-person The petitioner submits that he was resisted appearing before the learned Judicial Magistrate, Barrackpore in connection with Complain Case No. 488 of 2019. As such, it was not within his knowledge that the said complaint case had already been dismissed under Section 249 of the Code of Criminal Procedure, 1973 on September 8, 2022 for his non-appearance He further submits that without the knowledge of the dismissal of the complaint case, he filed CRR 1779/2021 for expeditious disposal of the said complaint case.

In view of the submissions made on behalf of the petitioner, there is no justification to proceed with the contempt application. Accordingly, CRLCP 14 of 2022 is dismissed.
