The present writ petition has been filed praying for a direction on the respondent No.5 to release a sum of Rs.3,58,777/- due and payable to the petitioner. Such amount, according to the petitioner, is lying with the Katwa -II Development Block and Katwa-II Panchayat Samiti Employees Co-operative Credit Society Limited. 3.

Mr.

Ray, learned Advocate appearing for the respondent No.5 submits that a sum of Rs.1,18,068/- has already been paid as the admitted amount to the petitioner, which the petitioner has duly received.

In view of the aforestated, there is a balance sum of Rs.2,40,709/-. Since this amount is disputed, the same cannot be decided in the present writ petition.

The petitioner has acknowledged payment of Rs.1,18,068/-.

6. Since the petitioner has an appropriately efficacious remedy, the petitioner is granted leave to make an application under Section 102 of the Co-operative Societies Act, 2006, in accordance with the Rules framed thereunder. 7.

Since it pertains to outstanding dues for a long period of time, the concerned Registrar is directed to dispose of the reference within a period of three months from the date of the application.

8. With the aforestated direction, the writ petition is disposed of.

9. There shall be no order as to costs.

10. Since affidavits have not been called for, allegations contained in the petition are deemed to have been denied.

11. Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking. (Reetobroto Kumar Mitra, J.)
