The grievance of the petitioners is that no communication has been made to them with regard to the fate of their representation dated 12th April, 2024.

Learned advocate representing the private respondents submits, upon instruction that, the order passed by this Court in the matter of Sri Sushanta Dutta Vs. The State of West Bengal & Ors. in WPA No. 19821 of 2021 on 23rd June, 2022 has taken care of the entire issue and necessary order has been passed.

From the documents handed over by the learned advocate representing the State respondents, it appears that, the representation of the petitioners was duly considered and their prayer stood rejected as the property in question was found to be vested to the State of West Bengal. A communication has been made by the Block Land & Land Reforms Officer to all the private parties in occupation of the subject land that, as per Section 14T (3) of the West Bengal Land Reforms Act read with Rule 14C of the West Bengal Land Reforms Rules in Case No. 1 (BDN) of 1997 it has been found that the scheduled land is
vested to the State of West Bengal. The record has been corrected in favour of the Collector, Government of West Bengal. The land schedule is mentioned as MouzaKulchanda, JL No. 65, P.S. Bhatar, LR Plot Nos. 992 and 993 measuring about 1.40 acre and 1.73 acre classified as 'Bagan' and 'Pukur' respectively.

As it appears that the subject land which the petitioner claims to possess is vested to the State of West Bengal, accordingly, the petitioners cannot be permitted to use the same for fishing without obtaining permission/license from the concerned authority.

The writ petition stands disposed of.
