Affidavit of service filed by the petitioner and the report submitted by the State are taken on record. The private respondent is not represented.
The petitioner complains that the private respondent who is her daughter in law and resides in the same house as the petitioner, which belongs to the petitioner's husband, since deceased, has been disturbing her peaceful possession therein, threatening her with dire consequences and restraining her from collecting rents from the tenants in the property, such rents being her only source of livelihood.
It appears from the report submitted by the State that pursuant to the complaint lodged by the petitioner, specific case has been registered and charge sheet submitted upon completion of investigation. In the event the petitioner is aggrieved by the investigation or the charge sheet, she is at liberty to file a narazi application before the jurisdictional Magistrate, ventilating her grievance.
In the meantime, the police authority shall keep strict vigil at the locale and ensure maintenance of peace and tranquility.
The police shall render necessary assistance/ protection to the petitioner in order to enable her to reside in her house peacefully and without any disturbance from any corner whatsoever.
With the above direction, the writ petition is disposed of.
There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
