1. Petitioner is the wife of the deceased. Deceased had committed suicide on 20.07.2023. Out of suspicion criminal case was registered by the mother of the deceased.

2. I have considered the allegations in the impugned charge sheet. It is alleged there was an illicit relationship between the petitioner and one Amritendu Roy. Deceased had protested and subsequently she committed suicide.

3. In view of the uncontroverted allegations with regard to illicit relationship and the mental agony suffered by the deceased leading to his suicide, I am of the opinion this is not a case to invoke inherent jurisdiction and quash the proceeding.

4. It is open to the petitioner to canvass his defence at the appropriate stage of the proceeding including stage of consideration of charge, if so advised.

5. With the aforesaid observations, CRR 3386 of 2024 is disposed of.

6. Photostat certified copy of this order, if applied for, be given to the petitioner on usual undertaking.
