AGP Mr. Nilay Baran Mondal ... for the State-respondent (s) The petitioner has informed the Officer-in-charge of Raina Police Station on or about 30th July, 2025 regarding a water-body being filled up.

State has submitted a report which reflects that a proceeding under Section 126 of the BNSS has been drawn up.

Having considered the submissions advanced by the petitioner, I am of the view that since filling up of a water-body is a violation of law under the West

Bengal Land Reforms Act, 1955 particularly with regard to Section 4D of the said Act, the police authorities would conduct an enquiry and, to that effect, will sent a requisition to the office of the BL&LRO for conducting an inspection as to whether the character of the land has been changed. If the BL&LRO comes to a conclusion and from the said report, it reveals that there has been any deviation of the character of land, the police authorities would, then, act in accordance with the terms of the West Bengal Land Reforms Act, 1955.

With the aforesaid observations, WPA 19410 of 2025 is disposed of.
