1) Petitioner participated in National Eligibility cum Entrance Test (UG) - 2025 and a case is attempted to be made out in the writ petition that she obtained 495 marks and her percentile in the said examination is 64.64. Based on such percentile, according to the petitioner, she ranked 9165 under SC category and 77853 in NEET All India (UG Medical). Considering the rank which appears from documents at pages 17 to 19 of the writ petition, it is submitted that petitioner is entitled to get admission in MBBS course for the session 2025. According to the petitioner NEET All India (UG Medical), 2025 rank i.e. 778539 and the marks i.e. 205 as it
appears from documents at pages 22 and 24 of the writ petition, are incorrect particulars. Petitioner needs to be considered for admission in Under Graduate medical education course for the session 2025 based on her marks i.e. 495.
2) Mr.
Menon, learned advocate representing National Testing Agency (for short, "NTA") submits on instruction that the documents relied upon by the petitioner which are at pages 17 to 19 of the writ petition are not genuine documents. It is submitted that petitioner's NEET All India (UG Medical) rank is 778539 and the marks which is awarded to the petitioner is 205 and percentile is 64.64. A copy of the email letter dated 4th June, 2025 issued on behalf of the NTA is placed before this Court and same is taken on record.
3) It is submitted on behalf of the NTA that said email letter dated 4th June, 2025 was forwarded to the petitioner enclosing OMR sheet of the NEET (UG) 2025 examination and opportunity was granted to the petitioner to challenge answer key on the official NEET UG portal. It is also submitted that result is declared on 14th June, 2025 and prior to that candidates who participated in NEET (UG) 2025 examination
were made known to the marks awarded to them by sending email letters enclosing OMR sheets.
4) Mr. Nag, learned advocate representing West Bengal Medical Counseling Committee being respondent no. 7 has submitted that if petitioner would have been awarded 495 marks then her percentile would be higher than 64.64 and in the event petitioner is awarded 205 marks the percentile is 64.64. Document which is at page 17 of the writ petition discloses that though petitioner is awarded 495 marks but her percentile is 64.64, which is found erroneous.
5) Since the documents which are at pages 17 to 19 of the writ petition based on which case is made out in the writ petitioner are disputed by learned advocates representing NTA, West Bengal Medical Counseling Committee and National Medical Commission, no relief can be granted to the petitioner.
6) Writ petition stands dismissed.
7) There shall be, however, no order as to costs.
8) Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
