1. Affidavit of service filed on behalf of the petitioner is taken on record.

2. Petitioner made an application for transfer on virtual mode on 26th June, 2022 on portal on general ground (distance). On 6th July, 2022 school authority where petitioner is presently working forwarded the transfer application to the concerned District Inspector of Schools (SE) for taking further steps. District Inspector of School (SE), in turn, processed the transfer application and forwarded to the West Bengal Central School Service Commission through portal on 6th July, 2022. Grievance of the petitioner is his transfer application is yet to be decided by the Commission.

3. State respondents and West Bengal Central School Service Commission are represented by learned advocates who have submitted due to suspension of

portal from 29th September, 2022 transfer application could not be contemporaneously decided.

4. Having considered the submissions made on behalf of the parties Secretary, West Bengal Central School Service Commission is directed to decide transfer application of the petitioner in accordance with law by 6 (six) weeks from the date of communication of this order. Decision to be taken by the Secretary shall be communicated to the petitioner by fortnight thereafter.

5. It is made clear that suspension of portal shall not be a ground to reject transfer application of the petitioner.

6. Leave is granted to the learned advocate for the petitioner to amend the cause title and add Secretary, West Bengal Central School Service Commission as additional respondent in course of this day.

7. Service of notice upon additional respondent stands dispensed with since West Bengal Central School Service Commission is represented by learned advocate.

8. Writ petition stands disposed of.

9. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings. (Saugata Bhattacharyya, J.)
