Petitioner is aggrieved by the fact that during the pendency of SAT 448 of 2008 the private respondents are trying to change the nature and character of the property. Learned advocate submits that a pond is being dug by the private respondents. Police authorities have submitted a report.

Report reflects that an enquiry was conducted and a proceeding under section 126 of the BNSS has been drawn against the private respondents.

Learned advocate for the private respondents submits that earlier the decree is in favour of the private respondents.

Be that as it may, so far as the dispute relating to the land is concerned, it would be for the Civil Court to decide the same. However, the police authorities would keep a strict vigil since they have already drawn up proceedings under section 126 of the BNSS and ensure that there is no breach of the peace and or any untoward incident because of the strained relationship existing between the parties. With the aforesaid observations WPA 19533 of 2025 is disposed of.

Report submitted be kept with the record. A copy of the report be handed over to both the parties.
