The petitioner is in custody since 4th of May, 2023 and has already deposited the sum of Rs.32,000/-, as submitted by the Learned Advocate appearing for the petitioner.

Ms. Biswas, Learned Advocate, appearing for the CESC Authority, acknowledges that such sum has already been deposited with the concerned authorities. Having regard to the nature of the case, which is under Section 135/138 of the Electricity Act, I am of the view that further detention of the petitioner is unwarranted in the facts of the case.

Accordingly the prayer for bail of the petitioner is Allowed.

Accordingly, the petitioner viz, Krishna Chowdhury shall be released on bail upon furnishing bond of Rs.10,000/- (Rupees Ten Thousand only), with two sureties of like amount each, one of whom must be local, to the satisfaction of the Learned Special Judge, Electricity Act, Barrackpore or the Learned ACJM, Barrackpore.

If on bail, the petitioner shall be physically present on each and every date so fixed by the Court. Accordingly, CRM(SB) 166 of 2023 is allowed.
