In view of the innocuous nature of the prayer made in the application, prior service of notice is not being directed.

The petitioner alleges that the petitioner's application for grant of letters of administration in respect of a Will has been protracted indefinitely. 3.

I find from the materials annexed to the application that inordinate delay has been occasioned in disposing of the matter. The proceeding was initiated as long back as in the year 2019 and is now pending at the peremptory hearing stage. However, several adjournments have been given.

Accordingly, CO 2887 of 2024 is disposed of by requesting the learned Judge, Fifth Bench, City Civil Court at Calcutta to dispose of OC 03 of 2022 pending in the said court as expeditiously as possible without granting unnecessary adjournments to either

side, positively within six months from the date of communication of this order to the learned Trial Judge.

No order as to costs.

The parties and all concerned shall act on the server copy of this order without insisting upon prior production of any certified copy for the purpose of compliance.
