For the Petitioner Mr. Rudradipta Nandy, ld. APP Ms. Sonali Das, Ms. Sreeparna Das, Advocates ... ...For the State Petitioner prays for cancellation of the order granting anticipatory bail dated August 22, 2022.
State is represented.
The order granting anticipatory bail passed by the jurisdictional Court is detailed and contains reasons. It takes note of the transactions between the private parties. It returns a finding with regard to the fact that the transactions between the private parties were commercial transactions. Part payments were made in respect of the commercial transaction. The disputes between the private parities are over business dues which arose out of the regular transactions. Learned Judge did not feel the requirement of custodial interrogation in the interest of the investigations. It cannot be said that the impugned order suffers from perversity.
In such circumstances, we find no reason to interfere with the impugned order.
Accordingly, CRM (DB) 2975 of 2022 is dismissed. (Debangsu Basak, J.) (Md. Shabbar Rashidi, J.)
