Petitioner is aggrieved by the fact that pursuant to the writ petition having been preferred, Bhowanipore P.S. Case No. 249 dated 24.08.2025 has been registered for investigation. However, there were other complaints with New Market Police Station which were not addressed by the police authorities. Consequently, petitioner is aggrieved by the action of the police authorities.

Learned advocates appearing for the private respondents dispute and deny the accusations made in the writ petition.

State has submitted reports from the respective police stations which reflect that already New Market P.S. Case No. 71 dated 01.04.2025, New Market P.S. Case No. 62 dated 19.03.2025 and Chetla P.S. Case No. 57 dated 21.07.2025 have been registered for investigation. There are title suits being T.S. No. 611/2025, T.S. No. 1046/2025 and T.S. No. 1274/2025 also pending between the parties before the learned VI Bench, City Civil Court, Calcutta.

Having considered that the petitioner and the private respondents are involved in number of criminal and civil proceedings, if any particular complaint has not been addressed by the police station after four criminal cases being registered, I am of the view that the petitioner would be at liberty to approach the jurisdictional Magistrate under the relevant provisions of law.

Learned Magistrate would assess and ascertain regarding the genuinity of the allegations and thereafter pass necessary directions as he deems fit and proper.

With the aforesaid observations, the writ petition being WPA 19657 of 2025 is disposed of. There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
