Petitioner seeks bail.
Learned advocate for the petitioner submits that the witness action and the trial are complete. The petitioner is in custody in excess of 11 years.
Learned lawyer for the State submits that today is the date fixed for argument.
Considering the fact that the petitioner is in custody in excess of 11 years and considering the fact that witness action at the trial is over, it would be appropriate to grant bail to the petitioner. The prayer for bail of the petitioner is allowed. Accordingly, we direct that in the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten Thousand only) with two sureties of like amount each, to the satisfaction of the Additional Chief Judicial Magistrate, Baruipur, south 24 Parganas, subject to the condition that during bail the petitioner shall appear before the Trial Court on every date of hearing
until further orders and on further condition that the petitioner while on bail shall not leave the jurisdiction of Bhangore Police Station and shall not intimidate witnesses and/or tamper with evidence in any manner whatsoever.
The application for bail being CRM 8670 of 2021 is, thus, disposed of.
