....For the Respondent No.5/ National Medical Council The petitioner secured an All India Rank for counseling 122044 under the "General" category in the National Eligibility cum Entrance Test (UG), 2021 as it appears from page 17 of the writ petition. Today Mr. Swapan Kr. Datta, learned senior counsel appearing for the State on instruction submitted that the last entrant in the "General" category was with the rank 33,527.

The petitioner being far below there is no scope to entertain this writ petition and the writ petition is purely devoid any merit.

Mr. Indranil Ray, learned counsel appearing for the added respondent, respondent no.5 vigorously opposed

this writ petition and vehemently submitted that this is an abuse of the process of law.

Considering the rival contentions of the parties and considering the materials on record, this Court thinks it fit not to entertain this writ petition at all as the same is devoid of any merit.

The writ petition, WPA 19954 of 2022 stands dismissed, without any order as to costs.
