Ms. Sumitra Das ... for the petitioner This application under Article of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Junior Division), 2nd Court, Paschim Medinipur to dispose of Title Suit No. 823 of 2022 expeditiously.

On the basis of the submissions made by the learned advocate for the petitioner that no date of hearing of the suit has been fixed after June 24, 2024, a report was called for from the learned Civil Judge (Junior Division), 2nd Court, Paschim Medinipur Sadar through the learned Judicial Service, High Court, Calcutta. Pursuant to the said order, the learned Civil Judge (Junior Division), 2nd Court, Paschim Medinipur, Sadar has submitted a report dated 30th August, 2025. It has been stated in the said report that since 20th February, 2025 the learned advocates of Bar Association, Midnapore are not appearing before the learned trial judge and such fact has also been communicated by the District Judge, Paschim Medinipur vide Memo dated 20th February, 2025.

C.O. 3078 of 2025 stands disposed of with the hope and trust that the learned Civil Judge (Junior Division), 2nd Court at Paschim Medinipur shall make an endeavour to dispose of Title Suit No. 823 of 2022 as expeditiously as possible without granting any unnecessary adjournments to either of the parties.

There shall be, however, no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
