This application under Article 227 of the Constitution of India is at the instance of the decree holder praying for a direction upon the learned Judge, Second Bench, Presidency Small Causes Court at Calcutta to dispose of the Title Suit No.33 of 2022 expeditiously.

The learned advocate appearing for the petitioner submits that the misc. case which has been filed under the provision of Order 21 Rule 97 of the Code of Civil Procedure is pending from the year 2022 and August 29, 2025 has been fixed for the evidence of the opposite party witness.

In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite party. However, the learned advocate-on-record of the petitioner shall be obliged to forward a copy of this application along with this order, upon the opposite party or upon the learned

advocate representing the opposite party before the learned Executing Court.

From the order-sheets appended to this application, this Court finds that August 29, 2025 was fixed for evidence of the opposite party witness. Since the decree was passed sometime in the month of September 2021 and the Misc. Case is pending from the year 2022, C.O. 3081 of 2025 stands disposed of by requesting the learned Judge, Second Bench, Presidency Small Causes Court at Calcutta to make an endeavour to dispose of the Misc. Case No.33 of 2022 as expeditiously as possible and preferably within a period of six months from the next date fixed by the learned Executing Court.
