The father of the petitioner was an employee of Baranagar Municipality. He died-in-harness on 5th May, 2013. The petitioner applied for compassionate appointment on 29th May, 2013.

The application of the petitioner was forwarded by the Municipality to the Director of Local Bodies in June 2016.

The petitioner is not aware about any decision being taken in the matter by the Director of Local Bodies.

Learned advocate appearing for the Municipality is also not able to enlighten the Court as to whether there has been any communication from the end of the

Director of Local Bodies on receipt of the application for compassionate appointment.

The present writ petition was filed in the year 2019. Keeping the same pending awaiting a decision from the Director of Local Bodies, will not serve any purpose.

In view of the above, the instant writ petition is disposed of by directing the Director of Local Bodies, the respondent no.4 herein to take a decision with regard to the application made by the petitioner seeking compassionate appointment as forwarded by the Baranagar Municipality.

The decision shall be taken in the matter at the earliest, but positively within a period of eight weeks from the date of communication of a copy of this order. A reasoned order shall be passed and communicated to the petitioner immediately thereafter. Learned advocate appearing for the petitioner is directed to forward a copy of the Death Certificate of the father of the petitioner, application for compassionate appointment made by the petitioner and the document showing forwarding the application of the petitioner to the Director of Local Bodies at the time of communicating the order of the Court.

The writ petition accordingly, stands disposed of. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
