Mr. Avishek Sinha, learned advocate appearing for the petitioner submits that there has been an inadvertent mistake so far as the court is concerned, in stead of learned Judicial Magistrate, 1st Court, Howrah the certified copy would reflect that the case being Golabari P.S.293 of 2017 is before the learned Judicial Magistrate, 1st Class, Municipal Court, Howrah, as such, the order dated 22.08.2023 must refer to the learned Judicial Magistrate, 1st Class, Municipal Court, Howrah. So far as the charge-sheeted witnesses are concerned in the second paragraph of the order dated 22.08.2023 it has been stated that there are four charge-sheeted witnesses. However, the same is in the supplementary charge-sheet and the original chargesheet refers to 12 witnesses. The learned trial court would take into account that there are 12 witnesses so relied upon by the prosecution.

This order be treated as part and parcel of the original

order dated 22.08.2023. The additions and/or corrections are in the nature of clerical and arithmetical error and, as such, the prayer in the application being CRAN 1 of 2023 is allowed.
