Despite service, none appears on behalf of the private respondent nos. 6 to 10, although the other parties are represented through counsel. Learned counsel for the petitioner contends that the petitioner is without electricity, since, even upon an application for new connection being made by the petitioner, the West Bengal State Electricity Distribution Company Limited (WBSEDCL) is not being able

to give such connection due to hindrance put up by respondent nos. 6 to 10 and their men and agents.

Learned counsel appearing for the WBSEDCL submits that the WBSEDCL has no issues in giving such connection subject to compliance of all formalities. However, it is submitted that in view of the obstruction created by the private respondents, police help may be granted to the WBSEDCL personnel at the relevant point of time.

Upon hearing learned counsel for the petitioner, the WBSEDCL and the State, WPA No. 19956 of 2022 is disposed of by directing the WBSEDCL to give new electricity connection to the petitioner subject to compliance of all formalities by the petitioner within a fortnight from the compliance of such formalities and/or this order, whichever is later.

In the event the WBSEDCL personnel face any obstruction from the end of the respondent nos. 6 to 10 and/or their men and agents while doing so, it will be open to the WBSEDCL personnel to approach the local police station for seeking police assistance in that regard.

If such an approach is made, the Officerin-Charge/Inspector-in-Charge (as applicable) of the said police station, that is, Haripal Police Station, shall grant such assistance to the personnel of the WBSEDCL at the cost of the petitioner.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
