Ms. Sabita Khutia (Bhunia) ...for the petitioner Ms. Debjani Mitra Neogi Mr. Sugata Mukherjee ...for the State The petitioner claims to be an unmarried daughter of a deceased primary school teacher. She prays for grant of family pension in her favour. She alleges that her application seeking family pension is pending consideration at the end of the District Inspector of Schools (PE), Howrah.

Without entering into the merits of the application filed by the petitioner, the instant writ petition is disposed of by directing the District Inspector of Schools (PE), Howrah, the fourth respondent herein, to consider the petitioner's application praying for grant of family pension in accordance with law by giving a reasoned decision, within a period of twelve weeks from the date of communication of this order. The decision once given shall be communicated to the petitioner immediately thereafter.

If it is found that the petitioner will be entitled to receive family pension, then necessary consequential steps shall be taken by the said respondent forthwith.

Learned advocate for the petitioner shall forward a copy of the representation received by the authority on September 1, 2023 (Annexure P9, p.21) at the time of communicating this order.

WPA No.20252 of 2024 stands disposed of.
