Mr. Tanmay Basu Mr. Shamik Bagchi ...for the petitioner Ms. Chama Mukherjee Mr. Gourav Das ..for the State The petitioner alleges inaction on the part of the Officer-in-Charge, Kashipur Police Station. It is contended that the petitioner was appointed by the concerned Block Development Officer. The petitioner is the self-help group, represented by its Secretary.

The petitioner submits that the said self-help group was engaged for cooking mid-day meals in different educational institutions under the Bhangore-II Gram Panchayat, by an order of the concerned Block Development dated December 10, 2009. It is alleged by the petitioner that the police authorities have not taken any steps. A complaint was lodged by the petitioner about the unlawful activities of some anti social persons which tried to oust the petitioner.

The Officer-in-Charge, Kashipur Police Station has filed a report. The same is taken on record. It

appears that S.I. Santanu Das enquired into the matter. In course of enquiry, it was found that one Rahela Begam, wife of Abdul Matin Molla and some others of Village Bhumru, Post Office Raghunathpur, Police Station Kashipur were cooking the mid-day meal for Kantadanga FR School. The issue was diarised by the police authorities.

Under such circumstance, the police authorities cannot decide who were the rightful suppliers appointed by an appropriate order of the competent authority. The petitioner has already approached the administration.

The remedy of the petitioner would be before the appropriate authority, in accordance with law. This Court has not gone into the merits of the allegations and the findings of the enquiry made by the police.

This writ petition is disposed of.

There will be, however, no order as to costs. All parties are to act on the basis of the server copy of this order.
