Datta ...... for the petitioner Mr. Raja Saha Mr. Shamim ul Bari .... for the State The only prayer of the petitioner is that the Directorate of Public Instructions considers the representation made by the petitioner on July 19, 2021 for compassionate appointment on the death of the petitioner's husband. The petitioner's husband died-inharness on 18th August, 2018 while serving as Group-D employee in the concerned College. It appears that by a communication dated 18th January, 2021, the Teacherin-Charge of the College has approved the plea of the petitioner and has communicated the same to the Directorate of Public Instruction. The Directorate of Public Instruction has however not taken any steps following that letter.

Upon hearing learned counsel, this Court is of the view that the Directorate of Public Instruction has no reason not to respond to the representation of 19th

July, 2021 particularly when the College has requested that the petitioner be given an appointment commensurate to the financial condition of the petitioner and the facts of the matter.

WPA 20681 of 2021 is accordingly allowed in terms of prayer 'd'. The Directorate of Public Instruction being respondent No. 2 is directed to consider and dispose of the representation made by the petitioner on 19th July, 2021 within four weeks from the date of communication of this order. The reasoned order be passed in accordance with law and after hearing all concerned parties including the petitioner. Needless to say, if the petitioner is found eligible under the relevant Rules and Notifications, the petitioner should be given employment as recommended by the College without any further delay.

The writ petition is disposed of accordingly. (Moushumi Bhattacharya, J.)
