The private respondent No.10 is represented by the learned advocate. The private respondent denies the allegation of unauthorized construction.

It has been submitted that construction has been made in accordance with the sanctioned plan.

Howrah Municipal Corporation and the State are also represented.

It appears from the averment and the prayer made in the writ petition that allegation is in respect of the unauthorized construction at 151, Benaras Road, Salkia, P.S. Golabari, Howrah, Ward No.10 under the jurisdiction of the Howrah Municipal Corporation.

As the petitioner is not represented, the writ petition stands dismissed for default.

Dismissal of the writ petition will, however, not stand in the way of the Howrah Municipal Corporation to take steps against any unauthorized construction at the subject premises in accordance with law.
