This revisional application is filed by the petitioner for expeditious disposal of trial in ACGR Case No.201/2023 arising out of Matiabruz PS Case No.5 dated 12th January, 2023 under Section 420/120B of the Indian Penal Code pending before the Learned Judicial Magistrate, 9th Court at Alipore. 2.

It is submitted by the learned advocate representing the petitioner that charge sheet was submitted in this case in the month of May 2023 and long thereafter the matter has been transferred to the present Court on 5th August, 2024 and subsequent thereafter it transpires that till date charge has not been framed.

Heard the submission. Perused the record and copy of the order sheets of various dates wherefrom it transpires that complaint was lodged in the month of December 2022 alleging cheating. It further transpires that after the matter was

transferred before the trial Court all the accused persons did not appear. In view of the aforesaid facts and circumstances, the learned Court is directed to make an endeavour so that charge is framed at the earliest after compliance of all necessary formalities against the absentee accused persons. It is expected that within a reasonable period of time the learned Court will frame charge and proceed further with the case.

In the result, this criminal revisional application stands disposed of.
