The defendant in a suit for eviction is the petitioner of the instant application under Article 227 of the Constitution of India which is directed against order No. 77 dated April 25, 2024 and order no. 80 dated July 23, 2024 passed by the learned Judge, 4th Bench, Presidency Small Causes Court, Calcutta, in the said suit being Ejectment Suit No. 6879 of 2014.

The suit was posted for argument, at the stage the defendant had prayed for recalling of D.W.I to prove some documents, the learned Trial Judge by the first order impugned has refused the said prayer and by the second order impugned has refused to recall his earlier order.

In view of the stage of the suit, the orders impugned do not call for any interference.

C.O 2898 of 2024 is dismissed with the above terms without any order as to costs.

This Court is informed that September 02, 2024 is the date fixed for argument. The learned Trial Judge is requested to bring the suit to its logical conclusion as expeditiously as possible and in the event the defendant does not participate in the argument the learned Trial Judge shall close his argument.
