For the Petitioner Learned Advocate for the petitioner submits that Complaint Case No. 2567 of 2016 under Section 138/141 of the N.I. Act is pending since last seven years and the next date has been fixed on 13th of October, 2023 for crossexamination of the complainant. Learned Advocate submits that in a designed manner the accused persons are delaying the trial.

Having regard to the period of time for which the present proceedings are pending before the learned Judicial Magistrate, 5th Court, Alipore, I direct that on and from the next date, so fixed, the Learned Trial Court would fix one date in a month for the purpose of the present case so that the prosecution evidence is completed by February, 2024. The examination under Section 313 be completed by April, 2024. The defence be granted time till 31st of July, 2024 to complete its evidence and thereafter the Learned Trial Court

would take all efforts so that after the final arguments, the judgment of this case be pronounced by 30th of September, 2024.

With the aforesaid observations, CRR 3038 of 2023 is disposed of.
