Petitioner contends that the private respondents are illegally creating obstruction in plying the vehicle which belongs to that of the petitioner. Petitioner further claims that petitioner has a valid permit while the private respondents do not have any valid permit. According to the petitioner, information was furnished to the police authorities, but the police authorities did not take any steps.

A report has been submitted by the Officerin-Charge, Jangipara Police Station wherein several contentions have been advanced including

proceedings drawn up under Sections 126/135(3) of BNSS.

Primarily, I am of the view that this Court has got no determination to assess the contentions advanced in the present writ petition. The validity of a permit or illegality in plying a vehicle without a valid permit is absolutely the domain of the Court having determination for Transport and Telecommunication (Group-VII).

In view of the aforesaid, I am of the opinion that the writ petition is not maintainable. As such, the writ petition being WPA 19632 of 2025 is dismissed.

There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
