In view of the statement on behalf of the State that the name of the petitioner is not mentioned in the charge sheet and the case diary produced does not show the name of the petitioner has been included as one of the accused persons, we are disposed of the application by recording of the submission on behalf of the State to the effect that petitioner is not name as an accused in the charge sheet.
